Terms of Use

Welcome to Spartan Check. These General Terms of Use govern the access and use of our showcase website and our SaaS platform for static analysis of embedded C/C++ code. By accessing our services, you unreservedly accept these terms.

1. Legal Notice and Intellectual Property

A. Service Publisher

The Spartan Check service is published and operated by:

B. Intellectual Property and Industrial Filing

The technical architecture, the visual ergonomics of the dashboard (HUD), the semantic analysis rules, and the software structures of Spartan Check are the exclusive property of Morgan Hurel. These elements have been the subject of an official evidentiary filing with the INPI:

Any reproduction, representation, modification, or adaptation of all or part of the service, without the prior written consent of the author, is strictly prohibited and constitutes an infringement punishable by the Intellectual Property Code.

2. Client Source Code Ownership

Exclusive Client Ownership: You retain full and exclusive intellectual property of the source code (.c, .cpp, .h files, .zip archives) that you submit for analysis to Spartan Check.

Limited Analysis License: You solely grant us the temporary and technical right to run our analysis engines and authorized cloud infrastructure (including Google Cloud Run and Google Vertex AI) on your code for the strict execution of the service (generation of your audit report and remediation suggestions).

AI-Generated Remediations & Output Ownership: Spartan Check asserts no intellectual property claims, copyrights, or proprietary restrictions over the remediation patches, code diffs, or code snippets generated by our analysis engines or Google Vertex AI for your projects. All rights, title, and interest in and to such generated remediations are assigned to and retained exclusively by you.

Open-Source & Third-Party License Diligence: You acknowledge that you are solely responsible for verifying that any AI-suggested code fixes or modifications comply with the applicable open-source or proprietary licenses (e.g., GPL, LGPL, MIT, Apache, or commercial embedded licenses) governing your codebase prior to merging them into production builds.

3. Cloud Infrastructure & Artificial Intelligence (Google Cloud, Firebase, Vertex AI)

Backend Infrastructure (Firebase & Google Cloud Platform): The Spartan Check SaaS platform is hosted and operated on enterprise cloud infrastructure provided by Google Cloud Platform and Firebase. This includes sovereign European data residency (EU / France region) for account authentication (Firebase Auth), database services (Cloud Firestore), and isolated serverless execution environments (Google Cloud Run). All communications and stored data are protected using state-of-the-art cryptographic standards (TLS 1.3 in transit and AES-256 at rest). Client source code files submitted for audit are processed ephemerally within isolated containers and are promptly purged following report generation.

Artificial Intelligence Processing (Google Vertex AI): Spartan Check incorporates Google Cloud Vertex AI to deliver automated vulnerability explanations and contextual code remediation patches. By using our AI-assisted remediation features, you acknowledge and agree to the processing of isolated code snippets through Google Vertex AI under the following binding commitments:

  • Targeted Defect Scope: Spartan Check never transmits whole repositories or unexamined codebases to AI models. Only isolated code defect snippets and minimal contextual lines identified by our static analysis rules are routed to Google Vertex AI.
  • Source Code Sanitization: Prior to transmission to Vertex AI, source code comments, author details, and extraneous annotations are automatically stripped to prevent confidential or proprietary metadata from reaching third-party APIs.
  • Strict Zero-Retraining Guarantee: Under our Google Cloud enterprise terms, customer source code, defect snippets, prompts, and generated remediations are strictly quarantined. They are never used to train, retrain, fine-tune, or improve Google foundation models, public models, or any third-party artificial intelligence systems.
  • Ephemeral Processing & Zero Retention: Data sent to Google Vertex AI is processed transiently and is not retained or logged by the AI provider after the remediation response has been delivered to your audit report.
  • Human-in-the-Loop Supervision (EU AI Act Compliance): In accordance with European Union AI governance standards (Regulation (EU) 2024/1689), Spartan Check’s AI remediation engine operates exclusively as an assistive, decision-support tool. Spartan Check does not autonomously commit, compile, or deploy code to production environments. All suggested remediations require manual inspection, testing, and validation by a human engineer.

4. Access and Use of the Service

Capacity: The use of the service is reserved for professionals (independent developers, startups, large embedded systems accounts).

Credential Security: You are responsible for maintaining the confidentiality of your access credentials. Any activity on your account is deemed to be carried out by you.

Fair Use: You agree not to use the service to analyze malicious code or to attempt to saturate, bypass, or hack the Spartan Check infrastructure.

Export Control & Trade Sanctions: You represent and warrant that you are not located in an embargoed jurisdiction and are not identified on European Union, United States (OFAC), or United Nations designated sanctions lists. You agree not to submit source code or technical files that violate national defense secrecy laws (including French ANSSI defense secrecy classifications), or dual-use export control regulations (such as Council Regulation (EU) 2021/821 or US EAR) without possessing all requisite governmental authorizations.

5. Limitation of Liability (Technical Disclaimer)

Spartan Check is an assistance and decision-support tool for code compliance and robustness (including, but not limited to, BARR-C, ANSSI-C, CERT-C, and CERT-C++):

Obligation of Means: The static analysis and AI remediations proposed are technical optimization suggestions. The compliance or correction proposed by Spartan Check does not exempt the client from performing their own testing, hardware integration, and safety validation phases.

Safety-Critical Systems & Non-Certification Disclaimer: Spartan Check is designed as an advisory static analysis and bug repair tool for developer productivity. Spartan Check is not an officially tool-qualified or certified safety analysis tool under functional safety standards, including but not limited to ISO 26262 (Automotive ASIL/TCL), DO-178C / DO-330 (Avionics Software & Tool Qualification), IEC 62304 (Medical Device Software), or IEC 61508 (Industrial Functional Safety). Spartan Check must not be relied upon as an autonomous validation mechanism for mission-critical, flight-control, automotive braking/steering, life-support, or nuclear control systems. The client maintains sole and undivided responsibility for all hardware-in-the-loop (HIL) testing, safety cases, formal verification, and regulatory compliance filings.

Absence of Legal Warranty: The use of our tool shall in no event engage the liability of Spartan Check or its publisher for any residual bugs, failures of critical embedded systems, or legal proceedings related to the non-compliance of your software products.

6. Subscription, Cancellation, and Refund Policy

Merchant of Record: Our order process is conducted by our online reseller and Merchant of Record, Paddle.com, who also handles order-related inquiries and returns. Transactions are processed by Paddle Payments Ireland Ltd (EU) or Paddle.com Market Ltd (UK). Purchases are governed by Paddle’s Buyer Terms and Paddle’s Privacy Policy.

Subscription Cancellation: You can cancel your subscription at any time directly from the Billing settings in your dashboard. Cancellation takes effect at the conclusion of your current prepaid billing period, during which your access to features and unspent credit pools remains fully operational. No subsequent automatic renewal charges will be applied.

Right of Withdrawal (EU Consumers): In accordance with European Union consumer rights directives, consumers located within the European Union have the right to withdraw from their purchase and request a full refund within 14 calendar days from the date of initial subscription activation, without providing justification.

Annual Contracts & Commercial Terms: For annual commitments, enterprise contracts, or volume deployments, refund requests are assessed in accordance with the executed enterprise order form or applicable service-level commitments. Payment Security & PCI-DSS Compliance: All payment transactions are handled via encrypted channels directly by Paddle under strict PCI-DSS Level 1 compliance. Spartan Check does not handle, process, or store customer credit card numbers or payment instrument credentials.

7. Data Processing Agreement (DPA)

For enterprise and team customers subject to the General Data Protection Regulation (GDPR) or equivalent international data protection laws, a formal Data Processing Agreement (DPA) incorporating European Commission Standard Contractual Clauses (SCCs) and technical/organizational security measures is available upon request. 8. Applicable Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute relating to the interpretation, execution, or validity of these Terms, and failing an amicable resolution, express jurisdiction is granted to the competent French courts.
